マドリッド協定規則の改正

規則第3規則(2)(b)の改正により、国際登録の出願人及び名義人は、世界知的所有権機関（WIPO）国際事務局に対して代理人を選任するためには、関連する公式様式を使用するように要求されます。また、規則第30規則(1)(b) の改正により、名義人は国際登録の更新を従来の満了日の 3箇月前より早い、6箇月前に行うことが可能になります。WIPO 国際事務局は名義人が必要な手数料を支払ったことを確認次第、当該更新を登録する満了日まで待たずに、国際登録の更新を登録し、当該更新証明書を発行し、指定締約国に通報します。

2021年1月、世界知的所有権機関（WIPO）が提供する国際登録出願の願書（MM2）等の様式が変更されました。これをもって、直ちに変更前の様式が使用できなくなるとの情報はありませんが、今後は、最新の様式を使用されることを推奨いたします。最新の様式については、【商標の国際出願】願書等様式から入手可能です。MM2の新様式の利用に当たっては、従前の注意事項に加えて、以下の点に御注意ください。（1）第2欄に出願人のEmailアドレスを、第4欄に代理人のEmailアドレスを記載してください。代理人を選任する場合でも、第2欄に出願人のEmailアドレスを記載する必要があります。詳細は以下「2．マドリッド議定書規則改正に伴うEmailアドレスの記載義務化」を御参照ください。（2）第7欄に標章を記載いただく際は、8cm平方の標章記載欄の背景色を白にしてください。

Iceland moves for Madrid e-filing

Iceland becomes the first Nordic country to offer the Madrid e-Filing service to trademark users, following Bulgaria a few weeks beforehand.

You can now file an international trademark application through Madrid e-Filing by the World Intellectual Property Office (WIPO) via the ISIPO. The electronic service is paperless, user friendly and safe. An international trademark application must be based on a national application that will be registered later, or on a pre-existing Icelandic registration. The application can be filed in four simple steps:

Simplified renewal of international registrationsInternational registrations are valid for ten years and can be renewed directly with WIPO. Amendments to Rule 30 of the Regulations under the Protocol simplify renewals considerably.For Contracting Parties that have declared for an individual fee per class, the renewal fee will be calculated taking into account only the number of classes for which protection has been granted.The simplification means that holders of international registrations who have been granted partial protection and are appealing such decision will no longer be required to pay individual fees for classes that are not protected upon renewal.Consequently, item 4 of the renewal form MM11 and the corresponding option in e-Renewal will be removed because they will no longer be required. Item 4 was used to give instructions to renew the international registration for all the goods and services with respect to a Contracting Party where the mark had been only partially protected. The new MM11 form will be available for download as from February 1, 2020.
