不正競争防止法等の一部改正 施行期日は来年4月と1月
1.改正法のうち、不正競争防止法改正関連の措置事項、他人の氏名を含む商標に係る登録拒絶要件の見直し、商標におけるコンセント制度の導入及び中小企業の特許に関する手数料の減免制度の見直しについての施行期日は、令和6年4月1日とすることとします。2.改正法のうち、優先権証明書のオンライン提出許容のための規定整備、書面手続のデジタル化のための改正、e-Filingによる商標の国際登録出願の手数料納付方法の見直し及び意匠の新規性喪失の例外規定の適用手続の要件緩和についての施行期日は、令和6年1月1日とすることとします。
令和6年1月1日からは、e-Filingにより商標の国際登録出願を行う者は、政令で定める額に相当する額をWIPO国際事務局に納付しなければならないとしたところ、政令で定める額は1件につき9000円となります。
