Myanmar Trademark Law becomes effective from April 1st

The Trademark Law enacted in 2019 will come into effect from 1 April 2023, according to the official notification.The Ministry of Commerce will receive filing for a trademark from the effective date. The centers will be opened to receive trademark applications in Yangon city and Nay Pyi Taw. This law will promote investment and commerce by protecting the trademarks and interest and legal rights of the owners. It also helps elevate the brand’s value and penetrate global markets, Yangon Region Chief Minister U Soe Thein said at an awareness event for the Trademark Law.

New Myanmer Trademarks Law Anticipated in March

On 12 January 2023, the Department of Intellectual Property of Myanmar (“DIPM”) under the Ministry of Commerce (“MOC”) issued a notice stating that the new Trade Mark Law (2019) is anticipated to come into force in March 2023. This Update highlights what parties should be aware of regarding the Trade Mark Law (2019) and the applicable procedures and requirements.

ミャンマー商標登録　延期されていたソフトオープニングが10月1日より開始

 

商標法の施行に伴う商標登録のソフトオープニングについては、一時延期されていましたが、2020年10月1日から半年間（2021年3月31）の期間となることが公表されています。また、このソフトオープニングに続いて、2021年4月1日より商標登録出願の正式開始となる見込みです。ソフトオープニングの開始までの期間は、現状のシステム（所有者の宣言書を登録するシステム）が適用になりますが、ソフトオープニング期間中は所有者の宣言書を登録した者は優先的は商標登録が可能となります。この場合に、使用の証拠を提出する必要があり、もし使用の証拠を提出できない場合でも、警告（Cautionary Notice）の新聞広告を代わりに使用の証拠にすることも可能です。

ソフトオープニング期間では、従前の商標所有についての登録された宣言(registered Declaration of Trademark Ownership)に基づく優先権を主張して再出願をすることができ、その出願によって2021年4月と予想されるミャンマー商標局の営業開始日(Grand opening)に出願されたものと看做されます。また、ミャンマー市場で使
用中の旧商標（未登記でも可）に基づいても再出願が可能です。ソフトオープニング期間における再出願には、従前の商標所有についての登録された宣言と共に使用についての証拠が要件（代理人による場合は委任状の提出も必要）となっています。

အသိဉာဏ်ပစ္စည်းမူပိုင်ခွင့်ဆိုင်ရာဥပဒေများ               နိုင်ငံတော်ဖွံ့ဖြိုးတိုးတက်ရေးအတွက် အရေးပါသည့် အောက်ဖော်ပြပါ အသိဉာဏ် ပစ္စည်းမူပိုင်ခွင့်ဥပဒေ(၄)ခုအား မူကြမ်းရေးဆွဲပြီးစီးပြီးဖြစ်ပါ၍ အတည်ပြုပြဋ္ဌာန်းနိုင်ရေး လွှတ်တော်တွင် ဆွေးနွေးနိုင်ခဲ့ပါသည်- (၁) တီထွင်မှုမူပိုင်ခွင့်ဥပဒေ (၂) စက်မှုဒီဇိုင်းမူပိုင်ခွင့်ဥပဒေ (၃) ကုန်အမှတ်တံဆိပ်ဥပဒေ (၄) မူပိုင်ခွင့်ဥပဒေ သုတေသနနှင့်ဖွံ့ဖြိုးရေးဆိုင်ရာဥပဒေများ                 သုတေသနနှင့်ဖွံ့ဖြိုးရေးလုပ်ငန်းများသည် နိုင်ငံတော်ဖွံ့ဖြိုး တိုးတက်ရေးအတွက် လွန်စွာအရေးပါသည့် အခန်းကဏ္ဍတွင် ပါဝင်ပါသဖြင့် သိပ္ပံနှင့်နည်းပညာ၊ သတင်း အချက်အလက်နည်းပညာ၊ လေကြောင်းနှင့်အာကာသဆိုင်ရာတီထွင်ဆန်းသစ်မှုနှင့် သုတေသနနှင့်ဖွံ့ဖြိုးရေးလုပ်ငန်းများ ဆောင်ရွက်နိုင်ရေးအတွက် တစ်ဖက်ဖော်ပြပါ ဥပဒေ(၃)ခုအား မူကြမ်းရေးဆွဲပြီးစီး၍ လွှတ်တော်တွင် ဆွေးနွေးနိုင်ခဲ့ပါသည်- (၁) သိပ္ပံ၊ နည်းပညာနှင့်ဆန်းသစ်တီထွင်မှုဥပဒေ (၂) မြန်မာနိုင်ငံသတင်းအချက်အလက်နည်းပညာဥပဒေ (၃) မြန်မာနိုင်ငံလေကြောင်းနှင့် အာကာသဖွံ့ဖြိုးတိုးတက်ရေး ဥပဒေ

現地代理人からの最新情報によれば、ミャンマーにおけるソフトオープニング期間の開始が遅れており、当初2019年12月20日に予定されていましたが、その開始時期は2020年3月末か4月末まで延期されます。ソフトオープニング期間は6ヶ月間続き、ミャンマー商標局の営業開始日は2020年10月と予想されています。ソフトオープニング期間では、従前の商標所有についての登録された宣言(registered Declaration of Trademark Ownership)に基づく優先権を主張して再出願をすることができ、その出願によって2020年10月と予想されるミャンマー商標局の営業開始日に出願されたものと看做されます。ソフトオープニング期間における再出願には、従前の商標所有についての登録された宣言と共に使用についての証拠が要件（代理人による場合は委任状の提出も必要）となっています。現時点で未だ商標所有についての宣言の手続をしていないミャンマー商標権の取得希望者及びその更新希望者は、2020年5月までは従前の従前の商標所有についての宣言の登録手続を進めて早めに警告の知らせを公表すべきです。この場合、使用の証拠を準備できない出願人については、警告の知らせをソフトオープニング期間の再出願に必要な使用についての証拠となるように公表することが望まれます。ソフトオープニング期間における優先権を主張した再出願は、異議申立のための公告に付され、異議申立のなかった出願が正式な審査を経て登録となります。現時点(2020.1.22)では、未だオフィシャルフィーは決定されていません。

Trademark Registration about to open in Myanmar: Soft opening. Rights holders can take advantage of the soft opening starting December 31st.  
Trademark right holders interested in obtaining a Trademark re-registration in Myanmar can do so starting December 31st, by taking advantage of the soft opening of the registrar which permits a preliminary filling. This soft opening filing is a re-registration system and is available to owners of tademarks that are registered under the Declaration of Ownership at the Registry of Deeds. Right holders should thus meet the following requirements in order to qualify for a soft opening application: Declaration of ownership, Legalized power of attorney, and Cautionary notice (if published)

The 2019 Myanmar Trademark Law, which was finally enacted on January 30, 2019, is an important step in the government’s efforts to attract foreign investment. The new law establishes a framework for a comprehensive trademark registration and protection system for both foreign and domestic trademark owners. While the effective date has not yet been announced, businesses are well advised to audit their trademark portfolios in preparation for new filings because existing trademark declarations and notices will no longer be sufficient to demonstrate ownership of marks once the new law is implemented.

ミャンマー知的財産関連法成立

ミャンマーで5月24日、知的財産関連法（商標法、工業意匠法、特許法、著作権法）が成立した。国際協力機構（JICA）が支援した（2019年6月3日JICAプロジェクトニュース参照）。ミャンマー政府は2020年までに知的財産庁の設立を目指しており、それに合わせて同法が施行される見通しだ。

The Upper House of the Myanmar Parliament passed the Trademark and Geographical Indication Bill on 15 February 2018.  The proposed new Trademark Law will bring Myanmar’s trade mark regime more in line with international standards, including the adoption of the Nice Classification.  The Bill still needs to be approved by the Lower House but it is expected that the new law will be in effect and implemented as early as around June 2018.
