キットカット（Kitkat）のチョコレートの４つ指の３Ｄ形状については、自他商品を識別する機能がないとの理由で、英国控訴裁判所は控訴したネッスルの主張を退ける判断をしています。英国控訴裁判所の判事は、４つ指構造のチョコレートの形状はキットカットの形状として広く知られているが、それを以ってその形状がオリジナルであるとすることはできず、その形状だけで１つの提供者からの商品と認識されるものではないと判断しています。
