今般、システム改修により、GBDに未収録の商標出願・登録についても、国際出願時に基礎情報を手動で入力することによりMadrid e-Filingを利用して国際出願をすることが可能となりました。これにより、国内商標出願後すぐに、その出願を基礎としてMadrid e-Filingから国際出願をすることができます。具体的な操作方法及び注意点については、以下「2. Madrid e-Filingによる出願の作成について」欄に記載のユーザーマニュアル「Madrid e-Filingによる出願手続（PDF：4,783KB）」をご覧ください。

WIPO Madrid e-Filing 6月1日から開始

Madrid e-Filingは、世界知的所有権機関（WIPO）が提供するマドリッド制度を利用する国際登録出願をオンラインで提出するためのWebサービスです。既に世界中の幾つかの国では、電子出願体制が整っておりました。本サービスを利用することにより、本国官庁に商標の国際登録出願を行うことができます。日本国特許庁では2022年6月1日よりMadrid e-Filingによる出願の受付を開始します。WIPO Madrid e-Filingを利用することにより、オンラインで国際登録出願しWIPOへの手数料納付を行うことができます。また、願書の記載事項にある不備の修正、WIPOからの欠陥通報に対する応答をMadrid e-Filingにて行うことができます

Madrid e-Filingとは何ですか？

Madrid e-Filingは、マドリッド制度を利用するための国際登録出願の書類を電子ファイルとしてオンラインで提出できるサービスです。日本国では特許庁が2022年6月1日よりMadrid e-Filingによる出願の受付を開始します。なお、事後指定書（MM4）、国際登録の名義人の変更の記録の請求書（MM5）、および国際登録の存続期間の更新の申請書（MM11）の各申請はe-filingではできません。

Madrid e-filingを開始するためのURLはどこになりますか？

WIPO IP PORTAL　https://efiling.madrid.wipo.int/iwa　になります。移動後、IDとパスワードでログインが必要です。

e-Filingを利用する場合、本国官庁手数料9,000円を納付するために利用可能な支払方法を教えてください。

以下の方法により、本国官庁への手数料納付を行うことができます。 1. 電子現金納付電子出願ソフトで納付番号を取得し、インターネットバンキング等で9,000円を納付（電子現金納付）。納付後に納付番号を記載した書面をMadrid e-Filingから添付ファイルとして届け出る、又は、納付番号を記載した手数料納付書を作成し、特許庁に持参又は郵送する。 2. 特許印紙特許印紙を貼付した手数料納付書を作成し、特許庁に持参又は郵送する。 3. 特許庁窓口における指定立替納付（クレジットカード納付）手数料納付書を作成し、特許庁に持参して、窓口で指定立替納付（クレジットカード納付）により納付する。 4．現金納付特許庁へ納付書の交付請求を行い、金融機関（日本銀行本店、支店、歳入代理店等）窓口を利用して納付する。納付済証を貼付した手数料納付書を作成し、特許庁に持参又は郵送する。なお予納（特許庁の予納台帳からの納付）、口座振替、および電子出願ソフトを利用した指定立替納付（クレジットカード納付）は利用できません。

e-Filingでインポートした基礎情報（日本の商標登録出願、商標登録）は最新の情報ですか。

基礎情報（日本の商標登録出願、商標登録情報）は、WIPO Global Brand Database（GBD）より取得されますが、WIPO Global Brand Database（GBD）収録時の情報となりますので、最新でない可能性もあります。出願情報を作成する際は、収録された情報を必ず確認し、必要な情報を修正してください。

e-Filingで出願する場合、標章を使用する意思の宣言書（MM18）の作成方法を教えてください。

指定締約国選択画面で、アメリカ合衆国（United States of America）を選択すると、標章を使用する意思の宣言書（MM18）を作成する画面が追加されます。当該画面より必要な情報を入力してください。操作方法の詳細は、ユーザーガイドをご確認ください。共同出願の場合には、全ての出願人を代表して、一人の出願人が署名しMM18 を作成して申請することができます。出願人人数分の MM18 を作成する必要はありません。なお米国資格の弁護士が代理人である場合には、代理人による署名で足ります。

2020年2月15日から施行される新ルールでは、電子で書類を提出することが必須となり、また、代理人の弁護士のEmailアドレスに加えて、出願人もEmailアドレスを提出する必要があります。出願人のEmailアドレスとしては、社内の個人アドレスやUSPTO向けに作成された法人のアドレスなどが適切なものとされますが、社外弁護士や外国の法律事務所のようなEmailアドレスは不適当とされます。出願形式としてTEAS RFは、TEAS Standardに名称変更されていますが、電子出願でEmailでの連絡をする形式で275ドルは変わりません。TEAS Plus（ID manual内のGS選択）も225ドルで変わりません。TEAS Regularが廃止となります。商品の使用見本に関しては、見本は実際の商標の使用を示さなければならないとされ、それは商品の上、商品の容器または包装の上、商品に貼られたラベルまたはタグ、または商品に関連する陳列部などとされます。使用見本とされるものには、たとえば、（1）実際に標章の付いた商品の写真またはコピー、（2）実際の商品の容器、包装、タグ、またはラベル（3）直接関連付けられた標章を表示する販売現場での陳列が含まれます。インターネットの情報を使用見本として提出する場合には、検証を有効にするために、見本のWebページのURLとページにアクセスまたは印刷された日付の両方を提供する必要があります。電子的に作り上げられた本物ではない見本は受け付けられないとするルールも確立されており、抜き打ち検査システムやAIなどを用いた不自然な信号処理を検知するシステムが導入されています。
