The Korean Intellectual Property Office recently updated the Trademark Examination Guidelines, the Similar Goods Examination Guidelines and the Trademark Act Enforcement Rules. The updates affect, among other things, Class 09 software descriptions and non-traditional and foreign language trademarks. This article summarises the most noteworthy changes.

韓国特許庁、商標トレンドを分析し、有名な他人の名称およびキャラクターの商標審査を強化する。韓国特許庁は、ペンス、ボギョムTVなど、最近問題になっている商標紛争は、商標使用者の正当な出願ではなく商標先取りにより他人の信用に便乗して経済的利益を得ようとする不正な目的の出願だと判断し、それに対する商標審査をさらに強化していくと発表した。現行商標法によると、商標使用者と全く関係のない第3者が、認知度の高いアイドルグループ・人気ユーチューバー・キャラクターなどの名称を商標出願すると、商標法第34条第1項第6号（著名な他人の氏名・名称）、第9号（周知商標）、第11号（著名商標）、第12号（需要者欺瞞）、第13号（不正な目的）を理由に拒絶している。

The Korean Intellectual Property Office (KIPO) has argued that recent trademark disputes involving Pengsu, Bogyeom TV, etc. are not due to legitimate applications by trademark users, but to unfair trade mark preemption that seeks to obtain economic benefits by piggybacking on the trust of others. It decided that the application was for the purpose, and announced that it would further strengthen its trademark examination.

Scotch whisky has gained greater legal protection in South Korea after being granted a certification trademark. The Scotch Whisky Association (SWA) said the move would help prevent the sale of fake products and ensure legal protection in South Korea after Brexit. The trademark will enhance protection currently available under the EU-South Korean free-trade agreement.
