The UK government has outlined its intention to offer EU registered trademarks a UK equivalent post-Brexit.In its latest draft agreement on the withdrawal of the UK from the EU, the UK revealed that it would create an equivalent cloned right during the Brexit post-transition period, which is planned to last from 29 March 2019, to 31 December 2020.

But Lord Justice Kitchin and Lord Justice Floyd have upheld a ruling made last year by a high court judge. The confectionery multinational Nestlé has lost the latest round of its long-running battle with rivals Cadbury to trademark the shape of the KitKat bar in the UK. The court of appeal ruled that the four-finger design had “no inherent distinctiveness”.
