On December 27, 2020, the Trademark Modernization Act of 2020 (“the Act”) became law as part of the Consolidated Appropriations Act, 2021. Among other changes, the Act includes important amendments to the Lanham Act:Establishes two new ex parte proceedings to cancel unused marks;Creates a uniform rule establishing a rebuttable presumption of irreparable harm for trademark infringement;Formalizes the procedure for Letters of Protest; andPermits the examiner to set shorter response times for office actions.

【法改正】Trademark Modernization Act（商標近代化法、TMA）により不使用を理由とする査定系抹消手続（Ex Parte Expungement）と査定系再審査手続（Ex Parte Reexamination）が新たに制度化されており、その施行日は2021年12月27日に決められています。また、商標権侵害があれば、それは反論できるものの回復不能な損害（rebuttable presumption of irreparable harm）が生じていると見なすものとなります。この推定規定から侵害での商標権者の挙証負担が軽減されます。また、拒絶理由通知（Office Action）の応答期間が6ヶ月から60日乃至6ヶ月と短く柔軟な期間を審査官が設定することができ、出願人側で6ヶ月とするには手数料がかかります。

Indonesia’s long-deliberated Omnibus Law (Law No. 11 of 2020) was enacted on November 2, 2020, implementing a number of amendments to Indonesia’s intellectual property laws.

Trademark Law
The Omnibus Law also makes a few amendments to the Trademark Law:

  • The law’s list of marks that are not registrable now includes marks containing a functional form.
  • To speed up the prosecution process, substantive examination will now be carried out as soon as the publication period ends, and will be completed within 30 days, if there is no opposition; or within 90 days if an opposition has been filed.
  • The amended law no longer mentions collection of the certificate, since all certificates are issued as e-certificates.

改正種苗法 成立

　ブランド果樹など新品種の農作物の海外流出防止を目的とした改正種苗法が2日の参院本会議で可決、成立した。高級ブドウの苗木が海外に流出し、国内の生産者らが経済的な被害を受けたことから法改正が決まった。改正法では、新品種の開発者が栽培地を国内または特定の都道府県に限定できるようにし、違反行為に対する差し止め請求権を認める。第三者に種苗が渡るリスクを減らすため、農家が収穫物から種子を採取して翌シーズンの生産に使う「自家増殖」については許諾制とする。一部を除き来年4月1日に施行の予定。

Among the most relevant changes in this new Federal Law for the Protection of Industrial Property in Mexico is the one contained in Article 214 (formerly 113 of the former Industrial Property Law), which stipulates additional requirements for the filling forms when submitting a new trademark application, such as “the description of the mark” and Article 216 which stipulates that “the graphic elements that are not part of the mark must be indicated by dashed or dotted lines on its representation”. These new requirements will be applicable for trademarks filed from November 5, 2020.
