平成29年度は、地域経済牽引事業の促進による地域の成長発展の基盤強化に関する法律（通称：地域未来投資促進法）の施行に伴い、地域団体商標の商標登録出願に係る主体要件の明確化に係る改訂を行った他、歴史的・文化的・伝統的価値のある標章からなる商標登録出願に関連する改訂、新しいタイプの商標に関する運用についての商標審査便覧の改訂、及び商標の使用又は商標の使用の意思を確認するための審査に関する運用に係る改訂を行いました。

使用意思の確認の審査が変更されます。具体的には、類似群のカウント方法を変更します。すなわち、１区分内における指定商品又は指定役務に付与されている類似群数を単純にカウントすることとします。例えば、現在１個としてカウントを行っている複数類似群が付与されている商品・役務についても、１個ではなく、付与されている数をカウントします。１区分内における類似群の上限数は、「２２個」とします。小売り等役務に係る取扱いについては変更しません。商標の使用の意思を明記した文書も援用することができることとします。だだし、出願後3～4年以内までに商標の使用又は商標の使用の意思があることに合理的な疑義がある場合は、あらためて確認を行うこととします。（商標審査便覧の改訂のお知らせより抜粋）
従前は商標法第3条1項柱書の拒絶理由に対して類似群コード数が７以下であれば拒絶理由はないものとの扱いでしたが、平成30年4月2日の審査からルール変更となり、新しいカウント方式での２２個の類似群コード数以下であれば拒絶理由を構成しないことになり、２３以上であれば拒絶理由有との判断になります。

[情報源]名鉄の電子警笛、特許庁が「音の商標」登録却下 [コメント]音の商標で、識別力のあるような社名や商品名が含まれる場合と、単に音だけの場合とでは取り扱いが異なることになります。登録へのハードルが高いのは、音だけの方で、成功例は正露丸のラッパ音などの僅かな例に限定されます。♪ミド＃ラー、ミド＃ラー、ミド＃ミラー－。名古屋鉄道が電車の駅接近時などに鳴らす電子警笛「ミュージックホーン」を「音の商標」として登録申請したものの、特許庁に却下されたことが分かった。音の商標は新しいタイプの商標として２０１５年に導入された。名鉄は１６年１月に申請して審査が進められたが、特許庁は昨年３月、却下を意味する「拒絶」の方針を示した。名鉄側には意見陳述の機会が与えられたが、今年２月８日、却下が正式に決まった。
