確かに商標権侵害としてブランド品の偽物防止の分野では刑事事件化もありでしょうが、類似が絡むような商標権侵害は民事手続に依存するのが殆どです。しかし、商標権侵害罪として条文も存在していて、侵害者に対して過剰に刑事罰を与えるように動けば動けないこともなく、一般の会社などは刑事事件化されると評判などに対するダメージはかなりのものと思います。刑事事件化するための要件がありそうで、まだ立法されていないという現状になるかと思います。
